These Terms and Conditions (“Terms”) govern your access to and use of the website www.thegutbasics.com (the “Site”) and any products or services offered by GutBasics (“GutBasics,” “we,” “us,” or “our”), a company founded by board-certified gastroenterologists and internal medicine and pediatric physicians and based in Bowling Green, Kentucky. By accessing or using the Site, or by purchasing our products — including our digestive wellness supplements (oral strips, chewable tablets, and capsules) and our children’s multivitamin gummies (collectively, the “Products”) — you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase our Products.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on the Site, including orders for children’s products. By using the Site, you represent that you meet this requirement and that any purchase of a children’s product is made by you as a parent or legal guardian on behalf of the child who will use it.

2. Important Health and Safety Disclaimer

GutBasics Products are dietary supplements intended to support occasional digestive wellness and general nutritional health. They are not intended as a substitute for professional medical advice, diagnosis, or treatment. Although GutBasics was founded by physicians, including pediatricians, information provided on the Site or by our team is for general informational purposes only and does not constitute medical advice or create a doctor-patient relationship.

Our children’s multivitamin gummies are intended for use only by children within the age range stated on the product label, and only under adult supervision. We reserve the right to refuse or cancel any order for any reason, including errors in pricing or product information, suspected fraud, or unauthorized or illegal activity. Prices for Products are subject to change without notice. You agree to provide accurate and complete payment and billing information for all purchases. Applicable sales tax will be added where required by law.

6. Shipping and Delivery

Shipping timeframes and costs will be provided at checkout. Risk of loss and title for Products purchased from us pass to you upon delivery to the shipping carrier. GutBasics is not responsible for delays caused by the shipping carrier or circumstances beyond our reasonable control.

7. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy, available at www.thegutbasics.com/policies/refund-policy, which is incorporated into these Terms by reference.

8. Intellectual Property

All content on the Site, including text, graphics, logos, product names, images, and software, is the property of GutBasics or its licensors and is protected by U.S. and international intellectual property laws. 12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GUTBASICS AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

13. Indemnification

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms, the Site, or the Products shall first be addressed through good-faith informal negotiation. If a dispute cannot be resolved informally, the parties agree that it shall be resolved by binding arbitration administered by the American Arbitration Association under its applicable rules, conducted in Warren County, Kentucky, except that either party may bring an individual action in small claims court. Any arbitration or proceeding shall be conducted on an individual basis, and you agree to waive any right to participate in a class action or class-wide arbitration.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and GutBasics regarding your use of the Site and Products, and supersede any prior agreements.

17. Changes to These Terms

We may revise these Terms from time to time. The updated Terms will be posted on this page with a revised “Effective Date.” Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
