GutBasics (“GutBasics,” “we,” “us,” or “our”) was founded by board-certified gastroenterologists and internal medicine and pediatric physicians, and is based in Bowling Green, Kentucky. We respect your privacy and are committed to protecting the personal information you share with us. This Privacy Policy describes how we collect, use, disclose, and safeguard information when you visit our website, www.thegutbasics.com (the “Site”), or purchase our products, including our digestive wellness supplements (oral strips, chewable tablets, and capsules) and our children’s multivitamin gummies (collectively, the “Products”). This Privacy Policy is incorporated into, and made a part of, our Terms and Conditions.

By using the Site, you agree to the collection, use, and sharing of information as described in this Privacy Policy. If you do not agree, please discontinue use of the Site.

California and Other State Residents: Additional privacy rights may apply to you. Please see Section 8 (“Your State Privacy Rights”) below for more information.

1. The Information We Collect

We collect two types of information: information that identifies you or could reasonably be linked to you (“personal information”), and information that does not identify you and cannot reasonably be used to identify you (“anonymous information”). • Order information, including billing address, shipping address, and the Products you purchase
• Payment information, such as credit card or other payment details, collected and processed securely by our third-party payment processor
• Account information, if you create an account with us, such as a username and password
• Communications you send to us, including customer service inquiries, product questions, and reviews
• Health-related information you voluntarily share with us, such as details provided in a customer service inquiry about your symptoms or Product experience

b. Information Collected Automatically

• Device and usage data, including IP address, browser type, operating system, referring URLs, pages viewed, and the dates/times of your visits
• Cookies, web beacons, and similar tracking technologies (see Section 3 below)
• Approximate location information derived from your IP address or device

The Site is not intended for children under the age of thirteen. We do not knowingly collect or solicit personal information directly from anyone under the age of thirteen. See Section 9 (“Children’s Privacy”) for more information, including how this applies to our children’s multivitamin gummies.

2. How We Collect Your Information

We collect information from you in two ways: information you voluntarily choose to provide, and information we collect automatically through technology used on the Site. You are not required to submit personal information to browse the Site, though certain features (such as placing an order) will require it.

Cookies and Similar Technologies

We use the following categories of cookies and related technologies on the Site:

• Necessary: Cookies required for the Site to function properly, including session cookies, security cookies, and consent cookies. These cannot be disabled if you wish to use the Site.
• Functional: Cookies that enable certain features or performance improvements but are not strictly necessary, such as analytics tools (for example, Google Analytics) that help us understand how visitors use the Site.
• Advertising: Cookies from advertising partners (for example, Meta, Google, or TikTok) that we may use to market our Products to you or measure the performance of our advertising.

Consistent with applicable law and any choices available to you, we may use the information we collect to:

• Respond to customer service inquiries and provide support

• Personalize your experience and the content we show you

4. How We Share Your Information

We do not sell your personal information to third parties for money. We may share your personal information in the following circumstances:

• When you direct us to share your information with another person or company
• With service providers who perform services on our behalf, such as payment processing, order fulfillment, shipping, hosting, customer support, and analytics
• With marketing and advertising partners, to deliver and measure the performance of advertising, subject to your choices described in Section 5

5. Sale or Sharing of Personal Information

GutBasics does not sell personal information in exchange for money. Depending on how you interact with our advertising cookies (see Section 2), our use of certain analytics and advertising technologies may be considered a “sale” or “share” of personal information under the CCPA and similar state laws — for example, when we use cookies to enable interest-based advertising through partners such as Meta, Google, or TikTok. You have the right to opt out of this activity at any time by adjusting your cookie preferences through your browser or any cookie preference tool available on the Site, or by contacting us using the information in the “Contact Us” section below.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law (for example, for tax, accounting, or legal compliance purposes). When personal information is no longer needed, we take reasonable steps to securely delete or de-identify it.

7. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, disclosure, alteration, or destruction. We regularly review our security practices. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

8. Your State Privacy Rights

If you are a resident of California, Virginia, Colorado, Connecticut, Utah, or another state with a comprehensive consumer privacy law, you may have some or all of the following rights regarding your personal information, subject to certain exceptions:

• Right to Know/Access: The right to request that we disclose what personal information we have collected, used, disclosed, and sold or shared about you, and to receive a copy of that information.
• Right to Delete: The right to request that we delete personal information we have collected from you, subject to certain exceptions (for example, information we must retain to comply with a legal obligation).
• Right to Correct: The right to request that we correct inaccurate personal information we maintain about you.
• Right to Opt Out of Sale/Sharing or Targeted Advertising: The right to direct us not to “sell” or “share” your personal information, or use it for targeted/cross-context behavioral advertising, as described in Section 5.
• Right to Limit Use of Sensitive Personal Information: The right to request that we limit our use of sensitive personal information (such as health information you voluntarily provide) to purposes necessary to provide the Products and services you request.
• Right of Non-Discrimination: We will not deny you goods or services, charge different prices, or provide a different level or quality of goods or services because you exercised your privacy rights.

How to Submit a Request. You may submit a request to exercise any of these rights by emailing us at gutbasics@gmail.com. We will confirm receipt of your request within 10 business days and will respond within 45 calendar days, which we may extend once by an additional 45 calendar days when reasonably necessary (we will notify you if an extension applies).

Verification of Identity. To protect your information, we may take reasonable steps to verify your identity before fulfilling a request, which may require you to provide additional information sufficient to confirm you are the person about whom we collected the personal information, or an authorized agent acting on their behalf.

Authorized Agents. You may designate an authorized agent to submit a request on your behalf by providing that agent with written permission signed by you. We may still require you to verify your own identity or confirm that you provided the agent permission to act on your behalf.

9. Marketing Communications and Opt-Out

If you have opted in to receive marketing emails or text messages from us, you may opt out at any time by clicking the “unsubscribe” link in any email, replying “STOP” to any text message, or contacting us directly. Even if you opt out of marketing communications, we may still send you transactional messages related to your orders.

10. Children's Privacy

The Site itself is not directed to, and we do not knowingly collect personal information directly from, children under the age of 13. While we offer a children’s multivitamin gummy product, any purchase, account, or contact information associated with that product must be submitted by a parent or legal guardian on the child’s behalf — we do not knowingly collect personal information from children through the Site. If we learn that we have collected personal information from a child under 13 without parental consent, we will take steps to delete that information promptly. Consumers under 18 years of age: GutBasics does not intentionally sell or share the personal information of consumers under the age of 18.

11. Third-Party Links

The Site may contain links to third-party websites that are not owned or controlled by GutBasics. This Privacy Policy does not apply to those third-party sites, and we are not responsible for their privacy practices or content. We encourage you to review the privacy policies of any third-party site before providing your information.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or applicable law. We will post the updated policy on this page with a revised “Effective Date,” and if required by law, we will provide additional notice or obtain your consent. Your continued use of the Site after any changes constitutes your acceptance of the updated Privacy Policy.
